INARA ORGANICS — TERMS OF SERVICE

Last updated: [insert publication date]

OVERVIEW

This website is operated by Inara Organics Pte. Ltd. (UEN: 201913791K), trading as Inara Organics. Throughout these Terms, “Inara Organics”, “we”, “us” and “our” refer to Inara Organics Pte. Ltd.

These Terms of Service govern your access to our website and your purchase and use of our products and related services, together referred to as the “Service”.

By using our website or placing an order, you agree to these Terms and the applicable policies referenced here, including our Privacy Policy, Shipping Policy and Returns and Refunds Policy. Please read them carefully before purchasing.

Our store is hosted on Shopify, which provides the e-commerce platform through which we sell our products.

Nothing in these Terms excludes, restricts or replaces any consumer right, statutory guarantee or remedy that cannot lawfully be excluded or restricted.

SECTION 1 — ONLINE STORE TERMS

You must be legally capable of entering into a binding contract to place an order. If you are purchasing on behalf of another person or organisation, you must have authority to do so.

You may use our website and products only for lawful purposes and in accordance with these Terms and the relevant product instructions.

You must not introduce malicious software, attempt unauthorised access, interfere with the operation of our website or misuse another person’s account or payment information.

We may restrict access where reasonably necessary to address fraud, security risks, unlawful conduct or a material breach of these Terms.

SECTION 2 — GENERAL CONDITIONS

We may decline an order or restrict a service for legitimate reasons, including suspected fraud, stock limitations, delivery restrictions or misuse of our website.

Unless we expressly agree otherwise, products are sold for personal use. Commercial resale, repackaging, relabelling or alteration of our products requires our prior written consent.

You must not reproduce, distribute, sell or commercially exploit our website content, branding or other intellectual property without permission, except as permitted by law.

SECTION 3 — WEBSITE INFORMATION AND MEDICAL ADVICE

We take reasonable care to provide accurate product information. Educational content, ingredient descriptions, articles, frequently asked questions and communications from our team are provided for general information.

They are not medical advice, diagnosis or treatment and do not establish a doctor–patient relationship.

Always consult a qualified doctor or dermatologist about a skin condition, suspected allergy or concern about whether a product is suitable for you. Do not disregard medical advice, delay seeking treatment, or stop or change prescribed medication because of information provided by Inara Organics.

Nothing in this section limits our responsibility for product descriptions, representations or other information where applicable law imposes that responsibility.

SECTION 4 — PRICES AND CHANGES TO THE SERVICE

Prices, availability and promotions may change before an order is accepted. Applicable delivery charges and taxes collected by us will be displayed at checkout.

Changes to prices or these Terms will not retrospectively change an accepted order unless required by law or agreed with you.

We may update, suspend or discontinue website features or products. Where this affects an existing order, we will contact you and provide any refund or other remedy required by applicable law.

SECTION 5 — PRODUCTS, COSMETIC PURPOSE AND RESULTS

Our skincare products are intended for cosmetic use, such as cleansing, moisturising, conditioning and maintaining skin in good condition, as described for the particular product.

Our cosmetic skincare products are not medicines and are not intended to diagnose, treat, cure or prevent any disease or medical condition, including eczema, psoriasis, skin infections or allergies.

We do not claim that our skincare products provide cures, miracle results, instant transformations or guaranteed outcomes.

Skin responses and results vary between individuals. We do not guarantee a particular result, timeframe or suitability for every person.

Descriptions of ingredients or their traditional uses do not establish that a finished product has a medical benefit. Customer experiences, reviews and photographs do not guarantee that another person will achieve the same outcome.

Where natural ingredients are used, minor variations in colour, scent or texture may occur between batches. Such variations do not excuse a product that is unsafe, defective or materially different from its description. Contact us if you suspect deterioration, contamination or a product defect.

Images are illustrative, and screen settings may affect displayed colours. We remain responsible for supplying products that conform to their description as required by law.

SECTION 6 — PATCH TESTING, ALLERGIES AND SAFE USE

Always carry out a small-area skin test, commonly called a patch test, before first using each skincare product or introducing a changed formulation. Follow the product’s specific testing and use instructions. If you are unsure how to test or use it safely, consult a doctor or dermatologist before use.

A home skin test is a precaution, not a medical allergy test. It cannot guarantee that irritation or an allergic reaction will not occur immediately or after repeated use.

Before using a product:

  • Read the complete ingredient list, directions, age restrictions and warnings on the packaging.
  • Do not use it if you know you are allergic to an ingredient. Do not use a home patch test to check whether a known allergen is safe for you.
  • Consult a doctor or dermatologist before use if you have sensitive or reactive skin, a diagnosed skin condition, a history of significant allergies, or are using prescribed skin treatments.
  • Consult your doctor before use during pregnancy or breastfeeding, or before using a product on a baby or child. Use only products expressly indicated for the relevant age group and purpose.
  • If you are uncertain whether the product is suitable for you, seek medical advice before applying it.

Natural, organic, botanical or plant-derived ingredients, including essential oils where present, may still cause sensitivity, irritation or allergic reactions. These descriptions do not mean that a product is allergen-free or suitable for everyone.

Unless the product’s directions expressly state otherwise, skincare products are for external use only. Do not ingest them. Avoid contact with eyes and mucous membranes, and do not apply to broken, infected or severely irritated skin. Follow all storage instructions, expiry dates and period-after-opening guidance. Keep products out of children’s reach.

Stop using the product immediately if irritation, redness, itching, burning, swelling or another adverse reaction occurs. Gently wash it off where appropriate and seek medical advice. Seek urgent medical assistance for a severe reaction, breathing difficulty or swelling affecting the face, mouth or throat.

Please also report suspected adverse reactions or product defects to hello@inaraorganics.com, including the product name, batch number if available, and a description of the issue. Contacting us is not a substitute for medical care.

These precautions do not waive your legal rights or automatically release Inara Organics from responsibility for an unsafe or defective product.

SECTION 7 — ORDERS, BILLING AND ACCOUNT INFORMATION

You agree to provide accurate and current contact, payment and delivery information and to notify us promptly of errors that may affect your order.

An automated order acknowledgement confirms receipt of your order. Acceptance occurs when we send a dispatch confirmation, unless we expressly confirm acceptance earlier.

Before acceptance, we may decline an order because of unavailable stock, a material listing error, suspected fraud or a delivery restriction. If we cannot fulfil an order for which payment has been collected, we will notify you and refund the amount paid for the cancelled items, together with any applicable delivery charges.

We will not substitute a materially different product or increase an agreed price without your consent.

You are responsible for keeping account access details confidential and notifying us promptly of suspected unauthorised use.

SECTION 8 — SHIPPING, RETURNS AND REFUNDS

Delivery arrangements are described in our Shipping Policy. Estimated delivery dates are estimates unless we expressly agree to a guaranteed date.

Returns, exchanges and refunds are addressed in our Returns and Refunds Policy.

Any hygiene-related restriction on returning opened skincare products applies only to the extent permitted by law. It does not remove applicable rights relating to faulty, unsafe, misdescribed or otherwise non-conforming goods.

An individual skin reaction does not, by itself, establish that a product is defective. Equally, opening, using or patch testing a product does not automatically remove your right to a remedy. We will assess reported concerns in accordance with the circumstances and applicable law.

If an order is damaged, incorrect, incomplete or appears defective, please contact hello@inaraorganics.com promptly so we can investigate.

SECTION 9 — THIRD-PARTY TOOLS AND LINKS

Our website may contain third-party tools or links to external websites. Those services may have their own terms and privacy policies.

We do not control independent third-party content or services and do not endorse them merely by providing access or a link.

To the extent permitted by law, we are not responsible for losses caused by independent third parties over whom we have no control. This does not exclude responsibility for our own conduct or for service providers where the law makes us responsible.

SECTION 10 — REVIEWS, FEEDBACK AND SUBMISSIONS

Reviews and submissions must reflect honest experiences and must not be unlawful, misleading, abusive or infringe another person’s rights.

If you submit a review for publication, you grant us a non-exclusive, royalty-free permission to display and reproduce it in connection with our products and business, subject to applicable privacy, advertising and intellectual property laws.

We may make minor formatting edits or shorten a review without changing its meaning. We will not knowingly present a review in a misleading way.

We may decline or remove content that contains unsupported medical claims, personal information, unlawful material or content unrelated to the product. We will not remove an otherwise compliant review solely because it is negative.

Private correspondence, health information and personal photographs are not automatically licensed for marketing use merely because you send them to customer support. We will obtain any permission required before using such material publicly.

SECTION 11 — PERSONAL INFORMATION

We handle personal information in accordance with our Privacy Policy and applicable data protection law.

Please review our Privacy Policy for information about collection, use, disclosure, retention and your available rights.

Please do not include sensitive medical information in public reviews. If you contact us about a reaction, share only the information reasonably needed to investigate the issue.

SECTION 12 — ERRORS AND PROHIBITED USES

We may correct errors in product descriptions, prices, promotions, availability or other website information. If an error materially affects an order, we will contact you and provide an appropriate resolution in accordance with applicable law.

You must not use our website to:

  • Commit fraud or other unlawful acts.
  • Impersonate another person or submit false information.
  • Infringe intellectual property, privacy or other legal rights.
  • Harass, threaten or abuse others.
  • Upload malicious software or interfere with security features.
  • Collect personal information without lawful authority.
  • Send spam or use automated access in a way that disrupts the Service.

We may take reasonable steps to prevent or address these activities.

SECTION 13 — WARRANTIES AND LIMITATION OF LIABILITY

We take reasonable care in providing our products and operating our website. However, we cannot guarantee that the website will always be available, uninterrupted or free from technical errors.

Subject to the protections below, we do not provide additional warranties beyond those expressly stated by us or required by law. We do not guarantee that every product will suit every skin type or produce a particular personal outcome.

To the extent permitted by applicable law, we are not responsible for loss caused by misuse, unauthorised alteration, improper storage, use beyond the stated expiry or recommended period after opening, or failure to follow clear product instructions and warnings, but only to the extent that the loss is attributable to that conduct. This does not exclude responsibility for our own negligence, breach of duty or a product defect.

Subject to applicable law and any requirement of reasonableness, we exclude liability for indirect or consequential losses and for business losses such as lost profits, business revenue or business opportunities arising from use of the website or products.

Nothing in these Terms excludes or limits liability for:

  • Death or personal injury caused by our negligence.
  • Fraud or fraudulent misrepresentation.
  • Breach of a statutory guarantee, condition or obligation that cannot lawfully be excluded or restricted.
  • Any other liability that applicable law does not permit us to exclude or restrict.

Nothing in these Terms limits mandatory remedies for defective, unsafe or misdescribed products, or rights under applicable consumer protection law, including Singapore’s Consumer Protection (Fair Trading) Act 2003.

A failure to carry out a patch test does not automatically waive a claim or establish that Inara Organics has no liability. Responsibility depends on the circumstances and applicable law.

SECTION 14 — RESPONSIBILITY FOR THIRD-PARTY CLAIMS

To the extent permitted by law and subject to any applicable requirement of reasonableness, you agree to reimburse us for reasonable, evidenced losses arising from a third-party claim directly caused by your fraudulent or unlawful use of the Service, intentional infringement of another person’s rights, or deliberate material breach of these Terms.

This obligation does not cover losses caused by our negligence, breach of these Terms, a defective product or the wrongful conduct of those for whom we are legally responsible. It does not require you to reimburse us for pursuing your lawful consumer rights.

We will notify you of a relevant claim and take reasonable steps to minimise the loss.

SECTION 15 — SEVERABILITY

If a provision of these Terms is found to be unlawful or unenforceable, it will be severed to the extent necessary. The remaining provisions will continue to apply where they can lawfully operate independently.

SECTION 16 — SUSPENSION AND TERMINATION

You may stop using our website at any time. Any cancellation of an existing order remains subject to applicable law and our relevant policies.

We may suspend or terminate access where reasonably necessary because of a material breach, fraud, unlawful conduct or a security risk. Where appropriate, we will notify you.

Suspension or termination does not remove rights or obligations that have already arisen, including obligations concerning accepted orders, refunds and consumer remedies.

SECTION 17 — ENTIRE AGREEMENT

These Terms, the policies incorporated into them and the terms applicable to your accepted order form the agreement between you and Inara Organics concerning the Service.

Nothing in this section excludes liability for misrepresentation, invalidates a binding product description or promise, or removes a right provided by applicable law.

Our failure to enforce a provision immediately does not waive our right to enforce it later.

SECTION 18 — GOVERNING LAW AND DISPUTES

These Terms are governed by the laws of Singapore.

Disputes may be brought before the courts of Singapore or another competent tribunal, including the Small Claims Tribunals where eligible.

If mandatory consumer protections in your country of residence apply, nothing in these Terms deprives you of those protections or requires you to pursue a claim in a forum contrary to applicable law.

Please contact us first at hello@inaraorganics.com so we have an opportunity to resolve your concern. This does not prevent you from exercising your legal rights.

SECTION 19 — CHANGES TO THESE TERMS

We may update these Terms by publishing a revised version and updating the date above. Where required by law, we will provide additional notice or obtain consent.

Updated Terms apply prospectively. The version applicable when your order was accepted will continue to govern that order unless a change is required by law or agreed with you.
